User Agreement

 The following describes the terms on which OurBix offers you access to our services. PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.

Peace and Welcome to OurBix dear customers. By using OurBix you agree to the following terms and conditions with OurBix. Even if you reside outside of the Maldives, you are still subject to Maldives laws, rules and regulations. If you have any questions, please contact us.

This Agreement is effective on 24th October 2010, for current users, and upon acceptance for new users.

Before you use OurBix sites, you must read and accept all of the terms and conditions in, and linked to, this page and the OurBix Privacy Policy. By accepting this User Agreement, you agree that this User Agreement and Privacy Policy will apply whenever you use OurBix sites or services.

OurBix reserves the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue OurBix sites or services.

While using eBay sites, services, you will not:

• Interfere with the OurBix site.
• Use profanity on the site.
• Infringe on OurBix’s intellectual property.
• Continue to use OurBix in anyway if their account is suspended or terminated.
• Falsely report that another member has violated an OurBix policy.
• violate any laws, our terms and conditions, rights or policies;
• use our sites and services if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from using our sites or services;
• fail to deliver payment for items purchased by you;
• give false, inaccurate, misleading, defamatory, or libelous information;
• take any action that may undermine the feedback or ratings;
• give your OurBix account (including feedback) and User ID to another party without our consent;
• use viruses or any other technologies that may harm OurBix;
• copy, modify or distribute content from the OurBix sites or services OurBix 's copyrights and trademarks.

Identity

OurBix users: 

• Must be at least 18 years old.
• Cannot misrepresent their identities.
• Must always provide valid and complete contact information and must always have a valid email address.
• Must choose their user ID without profanity, offensive or bad words in any languages.

Access, Interference and Abuse of OurBix

You agree that you will not use any robot, spider, scraper or other automated means to access the sites for any purpose.

Additionally, you agree that you will not:

• copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for your information) from OurBix;
• interfere or attempt to interfere with the proper working of the sites, services, or any activities conducted on or with the sites or services; or
• bypass our safety measures we may use to prevent or restrict access to the sites.

Without limiting other remedies, we may limit, suspend or terminate our service and user accounts, prohibit access to our sites and their content or services and take technical and legal steps to keep users off the sites if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of OurBix, or acting inconsistently with the letter or spirit of our policies.

You agree to indemnify us against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms of Service by you.

Buyer Protection

All OurBix customers can be confident enough to buy from our sites without fear or hesitation as we will always do our best to protect and safe guard all our transactions with our customers. All needed documentation will be mailed to the given mail addresses and as needed will be provided with printed documentation. Still, this in no way states that all transactions carried out will be hundred percent safe.

Holds

OurBix may hold cash which OurBix receives in the transactions for safety reasons.

Currencies

Unless otherwise stated, all item or services will be shown in Maldivian currency MRF and/or U.S. Dollars. You are responsible for paying for all that you buy from our sites and services in a timely manner with OurBix accepted and offered payment method. If a payment method fails you still have to use another OurBix accepted/or offered payment method until you have completely paid in full.

Limitation of Liability

You will not hold OurBix responsible for OurBix listing mistakes or wordings used on our sites, actions or inactions. You acknowledge that our sites are venues to allow anyone to buy just about anything, at anytime, from anywhere, in a variety of pricing formats and locations, such as stores, fixed price formats.

We cannot guarantee continuous or secure access to our sites or services, and operation of our sites, services may be interfered by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill or reputation, or any special, indirect or consequential damages arising, directly or indirectly, out of your use of or your inability to use our sites, services and tools.

Regardless of the previous paragraphs, if we are found to be liable, our liability to you or to any third party is limited to the full cost of the item or service you paid to us in the 6 months prior to the action giving rise to the liability.

Privacy

We do not sell or rent your personal information to third parties for their marketing purposes without your consent. We use your information only as described in the OurBix Privacy Policy. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. OurBix may disclose the User's identity and contact information, if if requested by a government or law enforcement body, other legal action, and OurBix shall not be liable for damages or results thereof and User agrees not to bring any action or claim against OurBix for such disclosure. If you object to your information being used in this way please do not use our sites or services.

Notices

Except as explicitly stated otherwise, legal or other notices shall be served on to the email address you provide to OurBix during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent. Alternatively, we may give you legal or other notice by mail to the address provided during the registration process. In such case, notice shall be deemed given three days after the date of mailing.

Legal Disputes

If a dispute arises between you and OurBix, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and OurBix agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services in accordance with one of the subsections below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

• General for Legal Disputes - This Agreement shall be governed in all respects by the laws of the Maldives as they apply to agreements entered into and to be performed entirely within Maldives between Maldivian residents and other countries residents, without regard to conflict of law. You agree that any claim or dispute you may have against OurBix must be resolved exclusively by a National court located in the Capitol City Male' of Maldives, except as otherwise agreed by the parties. You agree to submit to the personal jurisdiction of the courts located in the Capitol City Male' of Maldives for the purpose of litigating all such claims or disputes.
• Improperly Filed Disputes - All claims you bring against OurBix must be resolved in accordance with this Legal Disputes Section. All disputes filed or brought contrary to the Legal Disputes Section shall be considered improperly filed. Should you file a dispute contrary to the Legal Disputes Section, OurBix may recover attorneys' fees and costs up to $10000, provided that you have failed to promptly withdraw the claim.

All policies or rules are hereby incorporated into this User Agreement.

Orders and Payments

Orders can be made as cash for delivery, cash on delivery, pay cash for delivery, payment to our accounts with cheques or transfers as stated in our sites. By using OurBix you agree that you understand and accept that Pre-orders or normal orders may take up more time than specified to arrive due to transportation issues and item availability which may or may not be under OurBix's direct control and will not hold OurBix responsible for such delays or unavailability of items or services. You accept that you do understand and acknowledge that OurBix may or may not have items or services by itself but can and might use other parties that do have them to provide items or services listed in OurBix. You agree to pay in full for all the transactions that you carry out for yourself or for another person.

Delivery

Upon delivery, you agree to if needed for that transaction, to pay in cash all fees and charges incurred in connection with your order, including any and all applicable taxes, at the rate in effect when the charges were incurred.

Cancellations

If you wish to cancel your order prior to delivery, you may contact OurBix. however we, reserve the right to refuse cancellation in case order has already been dispatched for delivery prior to receipt of your request. In that case you are obligated to and agree to pay in full all charges occurred for that order.

RISK OF LOSS

All items purchased from OurBix are made pursuant to a shipping method available at that time. This means that the risk of loss and title for such items pass to you upon our order request to the supplier.

Final Word

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others doesn't waive our right to act with respect to subsequent or similar breaches.

We may amend this Agreement at any time by posting the amended terms on this site. Except as stated elsewhere, all amended terms shall automatically be effective 3 days after they are initially posted. Additionally, we will notify you through mail or mobile.

YOU (AND NOT OURBIX) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. THE ABOVE EXCLUSION MAY NOT APPLY TO YOU, TO THE EXTENT THAT APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES.
